Competition Law

Competition law is a highly specialised area of law. FLORET advises and litigates across the spectrum of Dutch and European competition law. We handle merger filings in the Netherlands and abroad. We also support businesses in civil and administrative proceedings in cases concerning cartel allegations, abuse of dominance and state aid. Key focus area is private damages litigation, both in follow-on and stand-alone cases. We review and draft commercial contracts and assist clients with the implementation of compliance programmes. FLORET acts as a strategic sparring partner and stands at your side during investigations by competition authorities.

Litigation against regulators

The ability to successfully challenge (imminent) decisions by regulators demands a thorough knowledge of the law and how it is applied. But just as important is a clear understanding of the rules that restrict the discretionary powers and acts of the regulators themselves. This makes litigation against regulators unique. We know what it takes to be successful.

The Hague district court dismisses excessive pricing claim against former legal monopolist on the basis of article 24 Dutch Competition Act

On 4 March 2015, the The Hague district court ruled on an excessive pricing claim brought against SDU, a former legal monopolist and a publisher of government and company information. Applying the United Brands test, the district court finds that neither the price-cost limb nor the price comparison limb are met and finds in favour of the defendant.
